Purchases

There are two main reasons why you might not be able to purchase from NIYOS:

There are some countries, which are either sanctioned or our financial services providers rate as high risk. If you are from a sanctioned country, NIYOS's online purchasing system disallows purchase. NIYOS complies with all relevant restrictions imposed on us and our financial services providers and cannot sell to you if you are from a sanctioned or high risk country. We have various means that we use to determine where our purchasers are based, including the location of the bank account or credit card issuer, the geolocation of the purchaser's IP address and other means.

If you are based in Hong Kong, we cannot sell to you online. NIYOS is headquartered in Hong Kong and has to treat local sales differently to international sales for accounting and taxation purposes. If you are from Hong Kong and wish to make a purchase, please contact us via our Contact page.

There are also a number of different systems that we and our partners use to filter out certain purchasers who we are unable to sell to. If you believe you have been incorrectly barred from completing a purchase, please contact us via our Contact page. To satisfy regulations and our service providers, we will likely require additional documentary support.

NIYOS AR Viewer

NIYOS AR viewer will be released soon on the Apple App Store!

The iOS version for iPhone and iPadOS version for iPad are currently in test. Many of the images on this site were taken using pre-release versions of the App.

No, not yet. The first release is for Apple's iOS for iPhone and iPadOS for iPad.

We do plan a NIYOS AR viewer for Android and will announce on this site as soon as we have more news about the Android version.

We will announce on this site as soon as we have more news about the Android version.

At present, we have no plans to release NIYOS AR viewer for PC or laptop.

To work effectively, the App needs a high quality backwards-facing camera (i.e. away from the user). Current designs of PCs and laptops are not really suitable. It is much more convenient to run NIYOS AR on a mobile device.

Upon release, you will be able to link your purchases of 3D art works from NIYOS to your NIYOS AR viewer, so you will be able to visualize your 3D art works in the real world using augmented reality. You can find examples of photos taken using the NIYOS AR viewer on this site.

We will provide further documentation on how to do this with the NIYOS AR viewer upon its release.

NFTs

No, not at present. NIYOS believes the future of NFTs will look very different to the past. We believe that in future NFTs, or more simply "digital tokens", will represent ownership of real art and collectibles -- whether physical, digital or hybrid -- rather than being primarily web links to a cloud storage location of an actual original digital art work. The current NFT model has too many flaws, such as those NFT storage links becoming broken, causing loss of access or control over the art work, as well as rampant identical copying of those original digital art works. In addition, many of the generative NFT art projects were promoting and selling art works generated by a computer; only human-created art works receive copyright protection under Copyright Law, so many of those art works can be freely copied, meaning they are of doubtful value.

NIYOS is focused on working with creators, collectors, museums and galleries to make available exceptional physical, digital and hybrid art works, alongside the new tools required to make full use of digital art innovations such as 3D printing, Augmented Reality (AR) and Virtual Reality (VR).

NIYOS remains at the forefront of innovation in art and collectibles; tokenization will be an important part of that. NIYOS will continue to enhance its offerings and partnerships in compliance with fast-moving regulatory frameworks and the policies of its financial and professional service providers.

The regulatory and financial services frameworks relating to the issuance of NFTs in each jurisdiction are also fast-evolving, as are the risk policies of service providers. NIYOS ensures that it remains fully compliant with all regulatory and financial services requirements and the risk policies of its partners. NIYOS will continue to enhance its digital offerings in line with evolving regulations and policies.

Any art work that you acquire through NIYOS includes non-commercial exclusive rights to that art work. Unless described otherwise, each art work is a one-off (1-of-1) original. When you purchase an art work, you become the exclusive owner, with the right to resell the entirety of your ownership rights, exactly as you can when you purchase a painting or sculpture from an art gallery.

As the exclusive owner of those rights, you hold the sole rights to be issued with a NFT, either via a third-party issuer approved by the artist or directly by the artist. NIYOS believes that the future of NFTs will look very different to the past, so NIYOS's role in "digital tokens" will evolve in line with the regulatory environment and policies of its financial service providers.

Licensing and Rights

You acquire the rights to display, reproduce and publish the art work for your own non-commercial purposes.

You can post photos or videos on Instagram, TikTok, YouTube, Snapchat, Facebook or any other similar services. You can also print, embroider, engrave or recreate using any other technique, provided you are not using the resulting merchandise or reproductions for commercial purposes (i.e. for sale or marketing purposes).

You may not use, display or reproduce the art work in any way that might harm the artist's reputation, imply the artist has made a commercial endorsement or for any political purpose without separate prior authorization.

If you are interested in a commercial arrangement, please contact us. Whether that is possible depends on the usage and the artist who retains the copyright.

Yes! is the simple answer, for your own non-commercial use.

As part of your art work purchase, the artist grants you the right to use your art work for non-commercial purposes. That means you can reproduce any art work you have purchased and publish or display it, provided you are not using the art work to generate commercial income.

For any commercial use, please contact us and let us know the specific art work(s) that you wish to use and an explanation of your intended use. Commercial use includes reproductions for sale, including prints, videos and merchandise, as well as marketing purposes. It includes the use of the art work in commercial content, endorsements, promotion or packaging of commercial products or services.

Whether a commercial arrangement is available depends on the usage and the artist who retains the copyright.

When it comes to copyright, NIYOS follows the same long-standing practice as the traditional art world. When you purchase a painting or sculpture from a gallery or artist, you acquire only the physical art work, which you can display as you please. The artist retains copyright in the art work under copyright law. Artists rarely sell copyright; it is not standard practice in the art world.

The digital art world is no different, except digital art works are easier to reproduce, publish and distribute. That means your art work has a greater opportunity to become famous, if you choose.

With our artists, you acquire more rights than you would usually acquire when purchasing a physical art work. Our artists grant you the right to display, publish and reproduce the art work for your own non-commercial use.

File Formats

Most art works include multiple file formats. The full list is included in the description of each art work.

For art works that include 2D images, we provide them in a square or rectangular PNG format (Portable Network Graphic), since it allows you to place the art work against a transparent background if it is not square or rectangular. This makes it easy for you to display your art work against any background color, shade or texture of your choice, which is not possible for JPG (Jpeg) images. We usually supply more than one 2D image in your download. Typically, you will receive a high resolution image and at least one smaller version that you can use as an avatar or icon.

For art works that include 3D files, they are usually published by NIYOS in the universal OBJ format. However, since these are intended for use with the NIYOS AR viewer and future platforms, these files are not included in any download that you make from our site upon initial purchase. The NIYOS AR viewer provides the ability to link to your purchased 3D art works and/or any others which you have permission to access. This is all through the integrated tools of the NIYOS AR viewer.

NIYOS provides files in a square or rectangular PNG format (Portable Network Graphic), since it allows you to place the art work against a transparent background if it is not square or rectangular. PNG supports an "alpha channel". This makes it easy for you to display your art work against any background color, shade or texture, which is not possible for JPG (Jpeg) or TIFF images.

Our 3D art work files are intended for use with the NIYOSs AR viewer and future platform offerings, so these files are not included in any download that you make from our site upon initial purchase. The NIYOS AR viewer is the main tool that allows you to visualize your 3D files.  It provides the ability to link to your purchased 3D art works and/or any others which you have permission to access.
